The lawsuit reveals that Jane Doe had initially developed a friendship with helicopter pilot David Martz in early 2002. Despite initial hesitation, she agreed to a helicopter trip in February 2003. Upon arriving at the helipad, Martz informed her that she would be sharing the ride with Tommy Lee instead of flying alone.
The lawsuit alleges that Martz wasted no time in mixing drinks shortly after takeoff. Throughout the flight, both Martz and Lee reportedly smoked weed and snorted cocaine. Doe, who claims to have refrained from drinking, states that Martz eventually advised her to “just relax.” Subsequently, she was asked to join Lee in the cockpit, purportedly to “get the best view,” and it was during this time that the alleged assault occurred.

According to the lawsuit, Tommy Lee forcibly groped, kissed, and penetrated Jane Doe with his fingers. The suit also claims that Lee attempted to force her to perform oral copulation.
